We were selling our house and buying one at the same time. The closing date was initially set for March 14 and then we had someone back out last minute on a house we were buying so we asked to close on the 14th and have delayed occupancy for a few days. Me, my wife, and 2 year old son were left essentially homeless because one of the realtors at McGraw decided (without consulting his clients) to not give us delayed occupancy. I’m not an expert on real estate, but when I’m going to a showing of a house and see that it is occupied I know that delayed occupancy is going to be part of the transaction. We were told that he doesn’t do delayed occupancy because the homeowners can damage the house in between signing and moving out. Closing on 2 houses in the same day is very difficult to make happen so I knew that I had to get a hotel for a couple of nights, no big deal. When the 20th came around we had all of the utilities out of our name and everything moved out of the house we were selling so there was no going back. The buyers for our house were not able to sign because lending fell through (something the realtor should know about well in advance especially after denying delayed occupancy). So a couple hundred dollars of nights in a hotel quickly turned into $1000 for a week and not enough clothes or food either. Keep in mind the sellers of the house I’m buying were in the same shoes and were sleeping on a rollout foam mattress for a week as well. Part of the contract for the selling of our house was to convey the $1500 fridge so my realtor asked if we could keep our fridge to make up for all the money and inconvenience of being homeless for a week. To top this all off the realtor again, without consulting his clients about it, replied back that the problem does not fall on his clients and the contract is going to stay the same. Which he isn’t wrong, but his decision falls on himself and would have been an easy compromise to defuse the situation. Signing day finally comes on March 26th and the realtor switched agencies before the transaction was completed. While it wasn’t McGraw’s fault of everything the realtor did, it is their fault of deciding to not do anything about it after everything was said and done because at the end of the day they decide who they hire and they hired one of the worst realtors I’ve ever heard of or experienced in my life.
