Mackenzie Rain of Mendo Sotheby's violated our trust by sharing a confidential report about our home with a third party after the sale had closed—without our permission. This put an insurance claim we were filing in jeopardy.

We only found out when the information got back to us, and when we confronted her directly, she admitted she had sent it and acknowledged she shouldn’t have. But instead of owning her mistake, she scrambled to cover it up—only researching the policy after she had already shared our report. Worse, she misrepresented that policy to us in an attempt to justify what she did. I know this because I confirmed the actual policy myself. Her broker/owner, Greg Burke, also admitted it was wrong. But when we asked for the email between Mackenzie and the home inspector who she shared our confidential information with so we could use them in our legal process with the inspector, they refused. Rather than taking responsibility, they engaged a lawyer and demanded we remove our factual reviews.

Of course it is not acceptable for a realtor to share confidential information after the end of escrow but that is their defense! Would you want to work with a realtor that shares your confidential info and uses that defense?

And that’s not where the ethical failures end. Mackenzie also recommended a home inspector, Jim Deering of Absolute Inspection Services, without disclosing a glaring conflict of interest—he’s married to a realtor in the same brokerage as the selling agent.

Instead of doing the right thing, they tried to intimidate us into silence. It is against the law to demand factual reviews be removed. Buyers and sellers deserve to know exactly who they’re dealing with. Proceed with extreme caution.
